The petitioner apprehends his arrest in Dumra P.S. Case No.206 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The informant on secret information of keeping the liquor in the house of the petitioner raided the house of the petitioner and recovered 12 bottles of Royal Stag each containing 180 ml. of liquor.
Learned counsel for the petitioner submits that the petitioner was not present in the house. The police might have transplanted the liquor in the house of the petitioner for implicating the petitioner in a false case. The petitioner has got no criminal antecedent but it appears that the recovery was
Patna High Court CR. MISC. No.70568 of 2019(2) dt.18-12-2019 2/2 made from the house of the petitioner in present of independent witnesses.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
