Petitioner seeks bail in a case registered under Sections 304B, 201, 494, 120B/34 of Indian Penal Code. It is submitted by the petitioner's counsel that certain independent witnesses, during investigation, have deposed in paragraph 60 to 63 of the case diary from which it appears that the petitioner was not responsible in the killing of his wife. This Court would notice that it is said that the victim along with her son was missing since 08.11.2016. First information report has been lodged by the victim's father on 09.11.2016. No steps have been taken by the petitioner, who was the husband, having the prime responsibility for safety of his wife.
Patna High Court Cr.Misc. No.16270 of 2018 (3) dt.26-04-2018 2/2 Considering the nature of the allegations, this Court, for the present, is not inclined to allow the prayer for bail of the petitioner. The same is rejected.
