1. Heard Mr. Deepak Kumar, learned counsel for the petitioner and Mr. Lalan Kumar, , learned APP for the State.
2. The petitioner apprehends his arrest in connection with Nawada P. S. Case No. 812 of 2024 dated 19.07.2024 registered for the offence(s) punishable under Section(s) 117(4), 118(1), 126(2), 74 and 109 of the BNS.
3. The main submissions advanced by the learned counsel for the petitioner are that the FIR has been registered against 11 named accused including the petitioner and 25 -30 unknown persons, in the alleged occurrence, four persons sustained injuries, out of whom three sustained simple injuries and only one sustained grievous injury, against the petitioner there is no specific allegation and he is simply said to be a member of the mob. No.76616 of 2025(2) dt.03-12-2025 2/2 fight took place in between two groups on the occasion of Moharram procession in which 4-5 persons from the petitioner's side also sustained injuries, there is case and counter case in between both the parties and the petitioner bears no criminal antecedent. It is lastly submitted that the petitioner is a 20 year old person.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. In the facts and circumstances of this case and considering the above submissions, this court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Nawada P. S. Case No. 812 of 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
