2. The petitioner seeks regular bail in connection with Haspura P.S. Case No. 57 of 2023 registered for the offence under Section 302 / 34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is of assault by fist to deceased as a result deceased fell down on the ground and blood started oozing from mouth, ear & nose.

4. Learned counsel for the petitioner submits that the petitioner is innocent committed no offence and has falsely been implicated in the present case. The petitioner is a man of clean antecedent and he is custody since 03.07.2023.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. On perusal of the FIR, impugned order dated 19.10.2023 and post mortem report, it appears that Doctor who conducted the postmortem report, the cause of death is not ascertained.

7. Considering the aforesaid facts and circumstances of the case and also taking into account the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court of SDJM, Daudnagar in connection with Haspura P.S. Case No. 57 of 2023.
