1. Heard Mr. Jyoti Ranjan Jha, learned counsel for the petitioner and Mr. Binod Kumar No.3, learned APP for the State.
2. The petitioner apprehends his arrest in connection with Bariyarpur P. S. Case No. 41 of 2025 dated 30.03.2025 registered for the offence(s) punishable under Section(s) 191(2), 191(3), 190, 126(2), 115(2), 223, 121(2), 132, 109 and 352 of the BNS.
3. The main submissions advanced by the learned counsel for the petitioner are that the FIR has been registered against 25 named accused and 50 unknown persons, as per the prosecution story, one namely Dev Raj Kumar @ Debu was arrested by the police in connection with another FIR, then the

No.76369 of 2025(2) dt.03-12-2025 2/3 villagers of the said person started protesting against the police party and demanded his release, resulting in the blocked of the National Highway, during that course, some police personnel sustained injuries and the petitioner has been made accused mainly on account of being a member of the mob but against him, there is no specific allegation. It is further submitted that three co-accused persons, namely, Sourabh Kumar, Rakesh Kumar and Jammat Kumar carrying similar nature of allegations, have been granted anticipatory bail by the coordinate Bench of this court vide order dated 19.11.2025 passed in Cr. Misc. No. 76503 of 2025.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of the case and considering the above submissions and coupled with the genesis of the occurrence, this court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Bariyarpur P. S. Case No. 41 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount
