JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-06-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected vide order dated 04.05.2016 passed in Cr. Misc. No. 15510 of 2016 and again prayer for bail of the petitioner was dismissed as withdrawn by order dated 11.01.2017 passed in Cr. Misc. No. 51334 of 2016, on the ground that the petitioner is suffering in custody since 11.11.2015, similarly situated co-accused Bablu Mahto @ Bablu, Sofendra Mahto and Naresh Mahto have been allowed bail, vide Annexure-3, and as such now the petitioner also deserves sympathetic consideration as it is alleged that the petitioner was armed with pistol at the time of occurrence.

Patna High Court Cr.Misc. No.27145 of 2018 (3) dt.20-06-2018 2/2 The learned A.P.P. fairly submits that the similarly situated co-accused have been allowed bail. In the facts and circumstances stated above, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J-II, Jamui in connection with Sessions Trial No. 74 of 2016 arising out of Sikandra P.S. Case No. 132 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
