2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 498A, 302 and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
3. It is a case of "dowry death".
4. It is submitted by learned counsel for the petitioner that petitioner is mother-in-law of the deceased. There is no specific allegation alleged against the petitioner and she is separate in mess & property and have got no concern with the affairs of the deceased and her husband, who is already in custody. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State and learned counsel for
Patna High Court CR. MISC. No.80055 of 2023(2) dt.10-01-2024 2/2 the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, in connection with Begusarai Muffasil (Singhaul O.P.) P.S. Case No. 213 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
