The petitioners apprehend their arrest in connection with Warisaliganj P.S. Case No. 207 of 2025 registered for the offences punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 61(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 66(B) & 66(D) of the IT Act.

The prosecution case, in short, that on secret information, the police raided Tanti Mirbigha and arrested six accused persons and recovered mobile phones, SIM cards,
Patna High Court CR. MISC. No.76117 of 2025(2) dt.21-11-2025 2/3 documents and customer data used for online loan fraud by impersonating bank staff. It is alleged that they used to cheat public in the name of Dhani Finance and Services for providing online loan.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence as alleged against them and have falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioners. Petitioners are stated to be man of clean antecedent. Other co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 19-11-2025, passed in Cr. Misc. No. 76415 of 2025. 5.
On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

Considering the rival submissions made by the learned counsel for the parties, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where
Patna High Court CR. MISC. No.76117 of 2025(2) dt.21-11-2025 3/3 the case is pending/successor court in connection with Warisaliganj P.S. Case No. 207 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
