The petitioner seeks regular bail in connection with Beldaur P.S. Case No. 186 of 2017 for the offences punishable under Sections 409, 420/34 of the Indian Penal Code. The allegation against the petitioner and the other coaccused persons is that they had withdrawn a sum of Rs.84,400/- fraudulently, which was meant for installation of solar light at Kanjri Panchayat.
The learned counsel for the petitioner submits that the petitioner is innocent and in fact the work has already been completed but since the place of work was not mentioned, the present F.I.R. has been lodged mistakenly. It is further submitted that the co-accused has already granted anticipatory bail by this
Patna High Court Cr.Misc. No.26111 of 2018 (3) dt.28-05-2018 2/2 Court vide order dated 11.04.2018 passed in Cr. Misc. No.14738 of 2018. It is further submitted that the petitioner is having a clean antecedent, barring one case in which he is already on bail. The petitioner is languishing in custody since 25.2.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 3rd, Khagaria in connection with Beldaur P.S. Case No. 186 of 2017.
