2. The petitioner seeks bail in connection with K.Hat P.S. Case No. 244 of 2025 registered for the offence under Sections 8, 20(b)(ii)(B) of the NDPS Act.
3. As per the prosecution case, the recovery is of 308.710 grams of smack from a four wheeler vehicle on which the petitioner was found travelling.
4. The petitioner is in custody since 15.06.2025.
5. It has been submitted by the learned counsel for the petitioner that the petitioner, who is a woman, is innocent and she has falsely been implicated in this case.
6. Considering the fact that the petitioner is a woman and nothing has been recovered from her possession,
Patna High Court CR. MISC. No.78825 of 2025(2) dt.19-11-2025 2/2 this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge, NDPS Act, Purnea/concerned Court below in connection K.Hat P.S. Case No. 244 of 2025.
8. As a condition of this order, the petitioner after being released on bail is directed to mark her attendance at Simri Bakhtiyarpur Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
9. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through her lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
