JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.1.2018 seeks bail in Muffassil PS Case No. 592 of 2017 registered under Sections 302 and 120B of the IPC.

The allegation in brief is that the informant's son was called by Priyanka Kumari, thereafter he did not return back and he was murdered and his dead body was recovered from the court-yard of Subhash Prasad.

Learned Counsel for the petitioner submits that the petitioner is agnate of Subhash Prasad but is separate in residence, mess and business, Subhash Prasad was grated bail by a coordinate Bench of this Court vide Cr. Misc. No. 23924 of 2018 and there is no eye witness of the occurrence.

Having considered the said facts and circumstances, the petitioner, namely, Shambhu Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM East Champaran at Motihari in connection with Muffasil PS Case No. 592 of 2017.
