The petitioner seeks bail in Khajauli P.S. Case No. 134 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

540 litres of country made liquor is said to have been recovered from the Bolero vehicle and the petitioner who happens to be the driver of the said vehicle was apprehended while two persons managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern

As a matter of fact, he had no knowledge of carrying of the aforesaid liquor in the bag by its commuters who managed to escape seeing the police party leaving the same in the vehicle. He has been falsely implicated in the case. He has no criminal antecedent. He has been languishing in custody since 09.11.2017. Co-accused, namely, Mukesh Yadav and Indrajeet Yadav has been enlarged on anticipatory bail by a co-ordinate bench of this court vide order dated 12.04.2018 passed in Cr. Misc. No. 20833 of 2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II cum Special Judge, Excise Act, Madhubani in connection with Khajauli P.S. Case No. 134 of 2017.
