The petitioner is accused in connection with Raushanganj P.S. Case No. 129 of 2019, registered under Sections 302 and 328 of the Indian Penal Code. The accusation is that in the morning of 07.07.2019 Sabina Khatoon, wife of Sarver Hussain, came at the door of the informant, Rinki Devi (petitioner) and started quarreling for dispute of money with Baijnath Yadav, husband of informant, Rinki Devi (petitioner). Due to intervention of neighbour, dispute was pacified. In the evening, Sarver Hussain, husband of Sabina Khatoon came at the house of informant, Rinki Devi (petitioner) and started to take toddy in association with

When informant, Rinki Devi (petitioner) came at her house then found her husband Baijnath Yadav at her door restless. On query, her husband Baijnath Yadav, replied that Sarver Hussain mixed the poison with toddy and administered him. While her husband was rushed at hospital but he died in course of treatment.
Learned counsel for the petitioner submits that it would appear from the FIR that on the basis of Fradbeyan of informant-petitioner, Rinki Devi, the present case has been lodged regarding administering of poison to her husband by coaccused, Sarver Hussain but in course of investigation, fatherin-law, mother-in-law and neighbour of the petitioner raised suspicion having hand of the petitioner in the murder of her husband, Baijnath Yadav in collusion with Sarver Hussain due to illicit relation with Sarver Hussain, except that nothing has been collected by the Investigating Officer against informant, Rinki Devi (petitioner). Further submission is that petitioner, who is lady, has no criminal antecedent and is in custody since 01.08.2019.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court CR. MISC. No.71391 of 2019(2) dt.11-12-2019 3/3 Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Gaya,. in connection with Raushanganj P.S.
