JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2019 This application, for grant of anticipatory bail, arises out of Karja P.S. Case No. 88/2018, disclosing offences under Section 364 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of kidnapping the minor daughter of brother in law of the informant. It further appears that the statement of the girl has been recorded under Section 164 Cr.P.C., in which, she has supported the allegation against the petitioner. Submission of learned counsel for the petitioner is that the has falsely been implicated in this case and no specific allegation has been attributed to him and there was love affair between the alleged victim girl and one Jitu thakur and she had fled away with him.

Patna High Court CR. MISC. No.70277 of 2019(4) dt.17-12-2019 2/2 Having heard both sides, considering the facts and circumstances as well as the statement of girl recorded under Section 164 Cr.P.C., I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
