====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 18-02-2025 Heard learned counsel for the petitioner and learned APP for the State as also learned counsel for the Informant. Perused the case diary.

2. The petitioner seeks bail in connection with Halsi P.S. Case No. 132 of 2024 instituted for the offences under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, the accusation against the petitioner is of firing upon the Informant's husband upon his head.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the

The petitioner and the Informant are close relative. There is a land dispute between the parties. He further submits that the report regarding nature and injury is to be obtained from the District Hospital, Lakhisarai. The petitioner has one criminal antecedent and is languishing in judicial custody since 27.07.2024 without any rhymes or reason. Charge-sheet has been submitted against the petitioner under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

On the other hand, learned A.P.P. for the State and the Informant have vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged against the petitioner is serious in nature. There is specific allegation of firing against the petitioner. The injury report supports the prosecution case. The petitioner has one criminal antecedent. The petitioner is named in the F.I.R. and, hence, he does not deserve bail.

6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner as also taking into account the nature of injury, let the petitioner, abovenamed, be
