ANJANA MISHRA ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 27.09.2019, in connection with Special Case No. 1309 of 2019 arising out of Sikti P.S. Case No. 164 of 2019 for the offenses under Sections 30 (a) of the Bihar Prohibition & Excise (Amendment) Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but from the motorcycle which was allegedly being driven by the petitioner. It is further submitted that the petitioner has got clean antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent,

Patna High Court CR. MISC. No.71566 of 2019(2) dt.19-11-2019 2/2 let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge, Araria, in connection with Special Case No. 1309 of 2019 arising out of Sikti P.S. Case No. 164 of 2019.
