The petitioner seeks bail in a case instituted for the offences under Sections 392 and 386 of the Indian Penal Code but charges have been framed under sections 395, 386 and 412 of the Indian Penal Code.

Prosecution allegation, in short, is that the accused persons looted Rs. 12,000/- from the informant and also withdrawn Rs. 20,000/- from the ATM card.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.5.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.70043 of 2019(2) dt.18-11-2019 2/2 petitioner. The petitioner is not named in the F.I.R. The petitioner is said to be sitting in the car which was a looted property. The petitioner had no knowledge that the car in question is looted property. Other co-accused has been granted bail vide order dated 16.7.2019 passed in Cr. Misc. No. 42717 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -III, Buxar in connection with Sessions Trial No. 173 of 2019 arising out of Buxar (Town) P.S. Case No. 374 of 2019.
