JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sitamarhi P.S. Case No. 735 of 2017 for the offences punishable under Section 302 read with Section 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner surfaced on the confessional statement of the co-accused. Counsel for the petitioner submits that the petitioner has no criminal antecedent and is in custody 20.9.2017. He further submits that similar circumstance other co-accused have been granted bail by Co-ordinate Bench of this Court in Cr. Misc. No. 63113 of 2017 vide order dated 21.02.2018, Cr. Misc. No. 63246 of 2017 vide order dated 21.02.2018 and Cr.Misc. No. 14894 of 2018 vide order dated

Patna High Court Cr.Misc. No.27904 of 2018(3) dt.03-07-2018 2/2 10.04.2018.

Considering the fact that similar circumstance other co-accused have been granted bail by the Co-ordinate Bench of this Court, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 735 of 2017.
