The petitioner seeks pre-arrest bail in connection with Aurangabad Complaint Case No.808 of 2018 registered under Sections 323 and 498(A) of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

It is contended by the learned counsel for the petitioner that after five years of marriage, the complainant/ opposite party no.2 has lodged this case alleging subjecting her to cruelty for non-fulfilment of demand dowry. He contended that the allegations made in the complaint are absolutely false. The case has been instituted on account of matrimonial discord.

Patna High Court CR. MISC. No.69917 of 2019(2) dt.27-11-2019 2/2 Learned counsel appearing for the complainant/ opposite party no.2 opposed the prayer for grant of pre-arrest bail. She submitted that the petitioner and his parents were demanding Rs. 3 lacs of dowry. Somehow the complainant's father paid Rs.50,000/- to them, but they did not satisfy them as a result of which, they ousted from her matrimonial house after taking all her belongings.

Regard being had to the nature of allegations and the submissions made above, in the event of arrest or surrender before the court below, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Aurangabad Complaint Case No.808 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
