The petitioner seeks regular bail in connection with Ahiyapur PS Case No. 1127 of 2023 dated 09.09.2023, for the offences registered under Sections 461, 379 and 411 of the Indian Penal Code.

As per prosecution case, twenty-four pieces of battery were stolen from a mobile tower and the petitioner was driving the pick-up van on which the said stolen batteries were loaded.

Learned counsel for the petitioner submits that the petitioner is a driver and not the owner of the pick-up van having no concern with the seized articles and nothing has been

He further submits that the petitioner has no criminal antecedents and he is in judicial custody since 10.09.2023 and charge-sheet has already been submitted in this case and there is no chance of tampering of the evidence by the petitioner.

Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner. 6.

Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named-above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in Ahiyapur PS Case No. 1127 of 2023.
