Petitioner, already in custody, seeks bail in connection with Saraiya PS Case No.323 of 2017, registered under Sections 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that suspicion is raised against the petitioner that having illicit relationship with the wife of the deceased, the deceased was killed in his in-laws place but the petitioner was not there and the postmortem report reveals that it is a case of suicide as the cause of death is hanging not of strangulation, moreover the wife of the deceased, Rekha Devi, who is also accused in this case, has been admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No.1931 of 2018 on 14.03.2018.

No.13877 of 2018(3) dt.02-05-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Umesh Pandit is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, West, Muzaffarpur in connection with Saraiya PS Case No.323 of 2017, giving rise to Sessions Trial No.268 of 2017.
