2. The petitioners apprehend their arrest in connection with Hajipur Sadar P.S. Case No. 610 of 2025, registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 303(2), 74, 109, 352, 351 (2) of the BNS.
3. Allegedly, in the morning of the fateful day, all the FIR named accused persons, caused interception in the way of the informant and when protest was made, the petitioners along with others variously armed, assaulted the informant and his
Patna High Court CR. MISC. No.76087 of 2025(2) dt.26-11-2025 2/3 family members, which led to serious injury. There is further allegation of snatching of valuable and misbehaving with the female members of the informant.
4. Learned Advocate for the petitioners submitted that in a free fight on account of land dispute, the persons of both the sides sustained injuries, besides institution of case and counter case. The petitioners' side also instituted Hajipur Sadar P.S. case No. 600 of 2025 on 24.07.2025 against the informant and others. So far the petitioners are concerned, out of five petitioners, three are ladies and petitioner no. 4 is an ailing old person. The petitioners undertake that they will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners have actively participated in the crime.
6. Regard being had to be submissions made on behalf of the parties and considering the factum of case and counter case, coupled with the genesis of occurrence, besides the fact that no injuries have been attributed to the petitioners, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a
Patna High Court CR. MISC. No.76087 of 2025(2) dt.26-11-2025 3/3 copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Hajipur Sadar P.S. Case No. 610 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
