JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in S. Tr. No.161 of 2016 arising out of Salkhua P.S. case No.84 of 2013 registered under Sections 147, 148, 149, 302, 384, 386 of the I.P.C. and 27 of the Arms Act, pending in the court of 1st Additional Sessions Judge, Saharsa.
The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is the main assailant and he has fired upon the deceased.
A report was called for from the Trial Court with regard to the stage of the trial. It has been reported that the charge has been framed and the summons have been issued to
Patna High Court Cr.Misc. No.23622 of 2018(4) dt.12-07-2018 2/2 the witnesses.
Considering the accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order. The District Magistrate, Saharsa and the Superintendent of Police, Saharsa are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.
