The petitioners seek regular bail in connection with Muzaffarpur Excise Case No.08 of 2018 for the offences punishable under Section(s) 30(a), 28 and 53 of the Bihar Prohibition and Excise Act, 2016..

The allegation is regarding the recovery of 1180.52 liters of illicit liquor from the truck.

The learned counsel for the petitioners submit that the petitioners are the driver and Khalasi of the said truck and they are neither owner nor the consignor of the articles, i.e., illicit liquor, hence they were not having knowledge about what was being

Patna High Court Cr.Misc. No.25016 of 2018 (3) dt.28-05-2018 2/2 carried in the truck. It is further submitted that the petitioners have a clean antecedent and are languishing in custody since 15.01.2018.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Muzaffarpur, in connection with Muzaffarpur Excise Case No.08 of 2018.
