ANJANA MISHRA ORAL ORDER 05-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 26.09.2019, in connection with Aurangabad Excise Case No. 1144 of 2019 for the offenses under Sections 30 (a) of the Bihar Prohibition & Excise Act, 2018.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but from a Tempo in which the petitioner was travelling. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent,

Patna High Court CR. MISC. No.70130 of 2019(2) dt.05-11-2019 2/2 let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII cum Special Judge, Excise, Aurangabad, in connection with Aurangabad Excise Case No. 1144 of 2019.
