JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Ara Mahila P.S. Case No. 76 of 2019 disclosing offence under Sections 323, 406, 420 and 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. As per F.I.R. the marriage of the petitioner was fixed with the daughter of the informant and it is alleged that with mutual consent he has taken Rs.5,00,000/-, later on refused to marry.

Submission of the learned counsel for the petitioner is that there is no piece of paper in support of payment of the amount and other co-accused including father of the petitioner have been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 27.11.2019 in Cr. Misc. No. 68838 of 2019.

Patna High Court CR. MISC. No.70396 of 2019(9) dt.16-01-2020 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub-Divisional Judicial Magistrate, Ara, Bhojpur, in connection with Ara Mahila P.S. Case No. 76 of 2019.
