JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Nayagaon PS case no. 107 of 2017 instituted for the offences punishable under Sections 399, 402, 414 of Indian Penal Code and 25(1-b)a, 26, 35 of Arms Act.

The allegation is regarding the police having conducted raid and arrested the accused persons including the petitioner herein and from the petitioner, one countrymade pistol and one mobile phone were recovered.

The learned counsel for the petitioner submits that the petitioner is languishing in custody 03.11.2017 and has been falsely implicated in the present case. It is further submitted that

Patna High Court Cr.Misc. No.22633 of 2018 (3) dt.28-06-2018 2/2 after being arrested in the present case, the petitioner has been implicated in four other cases, however earlier to the arrest of the petitioner in the present case, the petitioner was having a clean antecedent.

Having regard to the facts and circumstances of the case as also the submission of the learned counsel for the petitioner that the petitioner has been falsely implicated in other cases only after being arrested in the present case, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 13th, Chapra, Saran in connection with Nayagaon PS case no. 107 of 2017.
