2. The petitioner is apprehending his arrest in connection with Tarari P.S. Case No. 45 of 2024 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353 of the IPC and Section 27 of the Arms Act.
3. As per prosecution case, on 05.03.2024 informant received information that some persons assaulted the groom and groom's party and they did not allow to perform marriage. On the said information, informant along with police personnel reached at the spot and saw 20-30 persons standing on road having lathi and danda. It is alleged that when informant made enquiry from them, the accused persons attacked on the police party by means of bricks, lathi and danda as a result of which

It is further alleged that other police personnel also sustained injury in the alleged occurrence. It is further alleged that accused persons while fleeing away made 3-4 rounds of firing to create terror. Petitioner and others are said to have identified on the basis of photograph, video and identification made by the villagers.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case. Petitioner bears criminal antecedent of one case in which he is on bail. He further submits that on similar and identical allegation, co-accused Shashi Bhushan Paswan has already been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 16522 of 2025 and co-accused Vishal Kumar @ Vishal Paswan and others have also been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 28732 of 2025 and on principle of parity, petitioner deserves anticipatory bail.
5. The learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that petitioner is named in the FIR and he cannot escape from the allegation

Considering the facts and circumstances of the case, on similar and identical allegation co-accused has already been granted anticipatory bail by co-ordinate Benches of this Court, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ara, Bhojpur/ concerned court in connection with Tarari P.S. Case No. 45 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
