JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 24-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Madhepura (Ghailarh O.P.) P.S. Case No. 225/2017 registered under Section 392 of the Indian Penal Code.

Two unknown motorcycle borne criminals are said to have snatched motorcycle and two mobile sets of the informant.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. No incriminating article has been recovered from his conscious physical possession. There is nothing on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused

Patna High Court Cr.Misc. No.23751 of 2018 (3) dt.24-05-2018 Roshan Kumar, which has no evidentiary value in the eye of law. In the year 2017, two more criminal cases were lodged against the petitioner but he is on bail in all such cases. The petitioner has been languishing in custody since 31.07.2017 and co-accused Raushan Kumar @ Roshan Kumar has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 12.04.2018 passed in Cr. Misc. No. 15533/2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Ghailadh) P.S. Case No. 225/2017.
