2. Learned counsel for the petitioner submits that supplementary affidavit has already been filed therefore, the defect is ignored.
3. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 05.07.2023 passed in Cr. Misc. No. 38410 of 2023. The petitioner seeks bail in connection with Bairganiya P.S. Case No. 57/20214 registered for the offence punishable under Sections 386 of the Indian Penal Code.
4. It has been submitted by Mr. Amit Kumar that in the trial only one witness has been examined. The petitioner is in jail since 07.07.2021.
5. Considering the period of custody and also the
Patna High Court CR. MISC. No.87767 of 2024(4) dt.17-01-2025 2/2 delay in trial, this application is allowed.
6. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi/ concerned court in connection with Bairganiya P.S. Case No. 57/2021, subject to the condition that both the bailors should be the blood relatives of the petitioner.
7. The petitioner is directed to mark his attendance in Sugauli police station on 1st Sunday of every month. He will cooperate in the trial. He will appear in the trial either personally or through his lawyer on the date fixed. Failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
