JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-03-2020 Learned counsel for the petitioners is permitted to make necessary correction during the course of the day. Heard counsel for the petitioners and counsel appearing on behalf of the State as well as the informant. The petitioners are apprehending arrest in connection with Giriyak P.S. Case No. 263 of 2019 for offences under Sections 148, 149, 323, 324and 307 IPC and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. The petitioners and the informant are Gotias and there is land dispute between them. The alleged occurrence took place on account of taking over

Patna High Court CR. MISC. No.70406 of 2019(2) dt.05-03-2020 2/2 possession of the land. The injury sustained by the informant side is simple in nature. The fire arm injury is attributed to one Bhaju Yadav and not against these petitioners. The allegation gainst them is general and omnibus.

Considering the aforesaid, let the petitioners, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) each with two sureties of the like amount each to the satisfaction of the ACJM-I, Biharsharif, Nalanda in connection with Giriyak P.S. Case No. 263 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C.
