The petitioner seeks regular bail in connection with Guraru PS case no. 100 of 2017 instituted for the offences punishable under Sections 302/34 of Indian Penal Code, Section 27 of Arms Act and Section 17 of C.L.A. Act, 1967. The allegation is regarding two persons having arrived on motorcycle, concealing their faces and thereafter, Munsi of the deceased contractor disclosed about the identity of the deceased to them whereupon, both the accused persons shot at his abdomen and escaped away. It is alleged that for non-fulfilling the demand of levy, the deceased was killed.

No.27129 of 2018 (3) dt.31-05-2018 2/3 The learned counsel for the petitioner submits that the petitioner is not named in the FIR and at a later stage, the informant has stated about the complicity of the petitioner as well as co-accused Rinku Singh and another co-accused Krishna Singh, in their confessional statements, have disclosed the name of the petitioner as an accomplice and except that, there is no other material against the petitioner. It is further submitted that co-accused Krishna Singh has been admitted to bail by a co-ordinate Bench of this Court vide order dated 06.02.2018 passed in Cr. Misc. no. 1360 of 2018. It is further submitted that the petitioner is having a clean antecedent. It is lastly submitted that one other co-accused has also been granted bail vide order dated 17.02.2018 passed in Cr.

Misc. no. 4637 of 2018. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Vth, Gaya in connection with Guraru PS case no. 100 of 2017 .
