JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-01-2020 Petitioner seeks regular bail in connection with Durgawati P.S. Case No.317 of 2017 registered for the offences punishable under Sections 448, 307/34 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected by the then Co-ordinate Bench of this Court, vide order dated 11.01.2019 passed in Criminal Misc. No. 74237 of 2018. Submission of the learned counsel for the petitioner is that he is in custody for more than two years and the evidence of the prosecution has already been closed.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that he is main assailant and the evidence of the prosecution has already been closed.

Having heard both sides, in view of the submissions,

Patna High Court CR. MISC. No.79714 of 2019(4) dt.28-01-2020 2/2 made above, I am not inclined to grant bail to the petitioner. The trial court is directed to expedite the trial. With the above observations, this application is dismissed.
