JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under sections 272, 273/34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act 2016.

12 bottles of 7.50 ml of whiskey and 3 bottles of 7.50 ml of classic whiskey were recovered from possession of the petitioner for which petitioner is in jail custody since 28.07.2019 without having any criminal antecedent. Moreover, co-accused Badal Kumar @ Amit Kumar having, more or less, similar allegation has already been granted privilege of bail by co-ordinate Bench of this Court vide order dated 26.11.2019 passed in Cr. Misc. No. 76081 of 2019.

No.70962 of 2019(2) dt.04-12-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise, Samastipur in connection with Rosera P.S. Case No. 214 of 2019.
