The petitioner seeks bail in connection with Giriyak P.S. Case No. 263 of 2019, registered under Sections 147, 148, 149, 323, 324 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that 13 persons named in the F.I.R. including the petitioner, surrounded Prabhat Yadav and Kaushal Yadav, nephew of the informant Rubi Devi and started firing in which Prabhat Yadav and Kaushal Yadav sustained injury.
Learned counsel for the petitioner submits that, although, the petitioner is named in the F.I.R. along with 12 others, but no specific overt act has been attributed against the
Patna High Court CR. MISC. No.69814 of 2019(2) dt.27-11-2019 2/2 petitioner. Moreso, Prabhat Yadav and Kaushal Yadav sustained one firearm injury, which is simple in nature. Further submission is that while petitioner is accused in two other cases lodged from prosecution side, as detailed in paragraph No.3, but he is on bail. The petitioner is in custody since 23.07.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Bihar Sharif, Nalanda in connection with Giriyak P.S. Case No. 263 of 2019.
