This is an appeal under Section 14A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for regular bail by order dated 21.03.2018 in Kurhani P.S. Case No. 467 of 2017 passed by the learned 10th Additional Sessions Judge-cum-Special Judge (S.C./S.T. Act), Muzaffarpur in connection with the aforesaid case registered under Sections 147, 148, 149, 307, 385, 387, 504, 506 of the Indian Penal Code, Section 27 of the Arms Act as well as Sections 3(i)(x) of the SC/ST Act. The appellant allegedly caused firearm injury at the leg of the father of the informant. Co-accused Suman Kumar caused
Patna High Court CR. APP (SJ) No.1707 of 2018 dt.13-07-2018 2/2 firearm injury at the stomach of the informant. Others were making indiscriminate firing which caused injury to Babby Kumar. The appellant is in custody since 07.02.2018. Considering the nature of allegation against the appellant, let the appellant, above named, be released on bail after framing of the charges or after completion of nine months of custody whichever is earlier on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with the aforesaid case, subject to the condition that the appellant shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the appellant.
Accordingly, the impugned order is set aside and this appeal stands allowed.
