JUSTICE SANJAY KUMAR ORAL ORDER 09-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with S.Tr. No. 354/2017/ 110/2017 arising out of Daudnagar Police Station Case No. 53 of 2017 registered for the offences punishable under sections 25 (1-b)a, 26 (ii) of the Arms Act.

It has been submitted that the prayer for grant of regular bail of the petitioner was rejected by this Court in Cr. Misc. No. 43734 of 2017 on 20.09.2017 with a liberty to renew his prayer in the light of observation given in the said order. The petitioner is in custody for more than one year. A report as regards stage of trial was called for from the court below vide order dated 18.04.2018 and the court below

Patna High Court Cr.Misc. No.23568 of 2018 (3) dt.09-05-2018 2/2 in compliance of the said order, has sent report which shows that charge has not been framed.

In the facts and circumstances of the case, the above named petitioner is directed to be released on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Aurangabad in connection with S.Tr. No. 354/2017/ 110/2017 arising out of Daudnagar Police Station Case No. 53 of 2017, subject to conditions that (i) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court (ii) the petitioner will not induce any witness or tamper with the evidence (iii) the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
