The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120B of the Indian Penal Code and 3 and 4 of Prevention of Damage to Public Property Act. Prosecution allegation, in short, is that the accused persons were protesting on account of death of a person in an accident and became violent and damaged public property. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.8.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made

Patna High Court CR. MISC. No.73466 of 2019(2) dt.18-11-2019 2/2 against the petitioner. No specific overt act has been alleged against the petitioner. Altogether 86 persons were named in a road accident. The local residents were protesting against the said accident. Hence, the present case has been instituted. No specific allegation has been attributed against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 97/2018.
