The petitioner apprehends arrest in Barahiya P.S. Case No. 153 of 2017 instituted for the offence under Sections 419,420,467,468,171,120(B) of the IPC.

It has been submitted that petitioner is not named in the written report. The name of this petitioner has come subsequently during investigation as he was posted as Revenue Karamchari in the concerned block.

Counsel for the petitioner submits that in paragraph 10 of the bail petition, it is mentioned that no misappropriation of government money was made. The alleged irregular payment has already been recovered.

Counsel for the petitioner has produced copy of

Patna High Court Cr.Misc. No.20479 of 2018(3) dt.11-05-2018 2/3 Nazir receipts for consideration of the Court at the time of hearing of bail application. It has been further submitted that other co-accused with similar allegation has already been granted anticipatory bail by this Court vide order dated 07.03.2018 passed in Cr. Misc. No. 11188 of 2018. In such circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioner, named above, in the event of his arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barahiya P.S. Case No.

153 of 2017 to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, subject to condition as laid down u/S 438 (2) of the Cr. P.C.
