JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-12-2023 The present petition has been filed for extending the time granted to the petitioners to surrender before the learned Trial Court, as granted by this Court, by an order dated 23.05.2023, passed in Cr.Misc. No.6183 of 2023, whereby and whereunder six weeks' time was granted to the petitioners to surrender before the learned Court below in order to avail the privilege of regular bail.

The learned counsel for the petitioners has submitted that on account of the petitioners working outside the State of Bihar for the purposes of earning their livelihood, the order could not be communicated to them by the advocate-on-

No.80262 of 2023(2) dt.08-12-2023 2/2 record of the present case in time, hence they could not surrender within the prescribed time, thus a sympathetic view be taken and the time granted to the petitioners to surrender before the learned Court below be extended, by a further period of four weeks.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to extend the time granted to the petitioners to surrender before the learned Court of Judicial Magistrate, 1st Class, Muzaffarpur in connection with Bochaha P.S. Case No.279 of 2022, by a further period of four weeks from today. The rest of the order dated 23.05.2023 shall remain as it is.

The present petition stands disposed off with the aforesaid modification in the order dated 23.05.2023, passed in Cr.Misc. No.6183 of 2023.
