The petitioner in this case is seeking anticipatory bail in connection with Saharsa Sadar P.S. Case No.567 of 2013 registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case at the instance of his enemies. Learned counsel further submits that there is no specific allegation against the petitioner and there is no independent witness to support the prosecution case.

Learned APP for the State is present and has opposed the prayer for anticipatory bail of the petitioner.

No.75950 of 2019(2) dt.26-11-2019 2/3 Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that the allegations relate to an order passed by this petitioner in his capacity as Assistant Settlement Officer, the petitioner has already retired from the service in the year 2008, the FIR has been lodged five years thereafter and learned APP for the State confirms that at this stage the investigation is still pending, no charge-sheet has been filed against the petitioner, considering the totality of the circumstances, let the petitioner in the event of his arrest or surrender within a period of four weeks from today, be enlarged on bail on furnishing of bail bonds of Rs.

15,000/- (fifteen thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Saharsa in connection with Saharsa Sadar P.S. Case No.567 of 2013, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. i.e.

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police
