1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Udwantnagar P.S. Case No. 238 of 2024 registered under Sections 341, 323, 504, 307, 354(b), 448 / 34 of the I.P.C.

3. As per the prosecution case on 13.06.2024 in the morning while the informant was sitting at his door, the petitioner along with other accused persons, due to previous land dispute, started abusing the informant and the petitioner assaulted him by means of "lathi" on his head.

4. Learned counsel for the petitioner submits that the present occurrence has taken place due to land dispute between the parties, which would be evident from the F.I.R. itself. A counter case has been lodged by the side of the petitioner against the informant and others bearing Udwantnagar P.S. Case No. 280 of

Patna High Court CR. MISC. No.80471 of 2024(2) dt.10-12-2024 2/2 2024. Referring to the injury report at Annexure-4, learned counsel submits that injury caused to the informant is simple in nature. The petitioner is a student of B.A. Part-II and has been pursuing study.

Regard being had to the submission made by the parties, taking into consideration the fact that there is long standing land dispute between the parties, injury caused to the informant is simple in nature and the petitioner is a student, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwantnagar P.S. Case No. 238 of 2024 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anil Kumar Sinha, J) praful/- U T
