The petitioner seeks regular bail in connection with Narpatganj P.S. Case No.127 of 2018 registered for the offences punishable under Sections 376 and 511 of the Indian Penal Code and Section 8 of POCSO Act.

As per written report, the informant has alleged that while her daughter aged about 9 years was coming from school to home was pulled in maize field where the petitioner tried to commit rape on her.

It has been submitted that the allegation against the petitioner is false and frivolous. The petitioner and the informant are co-villagers and next neighbours having good relation but due

Patna High Court Cr.Misc. No.30505 of 2018 (3) dt.04-07-2018 to misconception this case has been lodged against the petitioner. He is in custody since 07.03.2018 having clean antecedent and so he deserves bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge (POCSO), Araria in connection with Narpatganj P.S. Case No.127 of 2018.
