JUSTICE SANJAY PRIYA ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Muzaffarpur Sadar P.S. Case No. 290 of 2016 instituted for the offence under Sections 395, 412 and 120(B) of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from his possession. The police has raided the house of one Punnu Kumar Singh and some articles were recovered from his house along with cash of Rs.1,00,000/-. Thereafter, police has arrested this petitioner on the basis of confessional statement of Punnu Kumar Singh. Punnu Kumar Singh disclosed the name of this petitioner

Patna High Court Cr.Misc. No.48771 of 2018 (5) dt.26-09-2018 2/2 and others. Counsel for the petitioner further submits that petitioner is in custody since 14.09.2017. Co-accused Mukesh Kumar Singh @ Mukesh Singh has already been granted bail by a coordinate Bench of this Court vide order dated 29.06.2018 passed in Cr. Misc. 28964 of the 2018.

Counsel for the opposite party No. 2 has appeared and opposed the prayer for bail of the petitioner. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, Muzaffarpur, in connection with Muzaffarpur Sadar P.S.
