Counsel for the petitioner submits that in respect of order of punishment dated 06.11.2015, petitioner has preferred this writ petition in the year 2019 as petitioner has been facing adverse circumstance on account of serious illness and death of his wife.
Counsel for State raises the issue regarding
Patna High Court CWJC No.22978 of 2019(2) dt.22-01-2020 2/2 maintainability of the instant petition, having regard to the remedy available to the petitioner under rule 24(2) of Bihar CCA Rule, 2005.
Counsel for the petitioner submits that he would be approaching the authority availing his remedy of review by filing memorial within four weeks from today. Since objection regarding maintainability has been taken by the State Counsel this court would observe that in the event, review is filed within four weeks, the same be disposed of expeditiously and without any undue delay, in accordance with law.
Writ petition is disposed of.
