2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 347, 323, 324, 325, 307, 120(B), 384, 385, 386, 447, 448 of the Indian Penal Code.
3. As per prosecution case, allegation against the petitioner is that he along with co-accused persons assaulted the informant and others due to which they sustained injuries.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is land dispute between both the parties due to which the petitioner
Patna High Court CR. MISC. No.82461 of 2023(3) dt.19-03-2024 2/2 has falsely been implicated in this case. There is case and counter case. The informant and his associates also assaulted the petitioner and his family members for which, a case bearing Azamnagar P.S. Case No. 293 of 2023 has been lodged. It is further submitted that the petitioner is languishing in judicial custody since 14.8.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Azamnagar P.S. Case No. 291 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar.
