This appeal has been filed for setting aside order dated 23.9.2023, passed in a case registered for the offence punishable under sections 323, 341, 504,354 of the IPC and sections 3(i)(r)(s)/3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, whereby prayer for anticipatory bail of the appellant has been rejected.
3. As per the prosecution case, appellant in an inebriated state entered the house of respondent no.2 and started abusing her and on raising alarm, when daughter of respondent no.2 came, this appellant misbehaved with her and abused by caste name.
4. Learned counsel appearing for the appellant
Patna High Court CR. APP (SJ) No.5297 of 2023(3) dt.18-07-2024 2/2 submits that the parties are co-villagers and due to some petty dispute, appellant has been implicated in the false and concocted case. Appellant claims clean antecedent.
5. Counsel for the State oppose the prayer for bail.
6. Considering the facts of the case, I do not find any ground to interfere with the impugned order. Accordingly, this appeal, seeking pre-arrest of the appellant, is dismissed. (Prabhat Kumar Singh, J) Shashi U T
