2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.

3. The case of the prosecution that son of the informant namely, Sandip Kumar has gone from his house for some work. He was being called at Sai Nath Temple of Chhachubigha by a girl. The family members of the girl came to know about the relationship of the deceased. It is further alleged that the son of the informant was killed. When the informant went to Chhachubigha, he found that his son was lying dead.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal

Patna High Court CR. MISC. No.80488 of 2024(4) dt.04-02-2025 2/2 antecedent. It is also submitted that one Jitendra Singh was apprehended who has disclosed the name of this petitioner. It is next submitted that bike of brother-in-law of the petitioner was recovered from the possession but the said bike was not used in the occurrence. There is nothing except confessional statement of Jitendra and this petitioner. In this case charge-sheet has been submitted and cognizance has already been taken. It is further submitted that the petitioner is languishing in judicial custody since 01.05.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Giriyak (Katrisarai) P.S. Case No. 135 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif.
