KUMAR ORAL ORDER 18-08-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in Punpun P.S. Case No. 376 of 2017 registered for the offence punishable under Sections 394, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of being a conspirator in committing murder of the son of the informant. It has been submitted on behalf of the petitioner that she is innocent and has been falsely implicated in this case on mere suspicion as the FIR has been registered against three unknown. It has been further submitted that no material has come during investigation to show the complicity of the petitioner in this case. Similarly, situated co-accused person

Patna High Court Cr.Misc. No.41134 of 2018(3) dt.18-08-2018 2/2 have been granted bail by a co-ordinate bench of this Court vide order dated 05.07.2018 passed in Criminal Miscellaneous No. 24822 of 2018. Petitioner has got no criminal antecedent and is in custody since 31.01.2018.

Learned counsel for the informant vehemently opposes the prayer for bail of the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi, Patna, in connection with Punpun P.S.
