JUSTICE SANJAY PRIYA ORAL ORDER 29-06-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Pusa P.S. Case No. 36 of 2017 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 452, 504 and 506 of the Indian Penal Code.
The allegation against the petitioner in the written report is of assaulting the informant with Farsa on his head. Case diary has been received.
The injury report of the informant is available in paragraph-67 of the case diary which shows that the informant has sustained two injuries on his head and one injury on his left shoulder and movement of joint restricted at left shoulder joint. The patient was sent to higher centre for better treatment.
Patna High Court Cr.Misc. No.30618 of 2018 (3) dt.29-06-2018 2/2 In paragraph-3 of the bail petition it is mentioned that petitioner has criminal antecedent.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
